Oralys, Inc (hereinafter “Oralys” or “We”), we are committed to providing our clients, customers, members with exceptional service and products. As providing this service and products involves the collection, use and disclosure of some personal information about our clients, customers, members, protecting their personal information is one of our highest priorities

Indeed, respects and values the privacy rights of its clients, customers and members has always been committed to protecting all personal information in its possession or control.

We have adopted this Privacy Policy. Such Privacy Policy explains what information Oralys, Inc. collect about You, how We collect, use and disclose the Personal information and what We may do with that information

Scope of this Policy

This Privacy Policy applies to all subsidiaries and affiliates of Oralys. References to "Oralys", or We" in this Policy include all such subsidiaries and affiliates.

We have developed this Privacy Policy to clearly define our ongoing commitment to protecting privacy rights and reflect requirements set out in both provincial and federal privacy legislation.

By visiting the various websites and domain names owned and operated by Oralys, and any other linked pages, features, content, mobile application or application services offered from time to time by Oralys in connection therewith, or using any of our products and/or services (collectively, the “Website”), You acknowledge that You accept the practices and policies outlined in this Privacy Policy.


We will obtain your consent to collect, use or disclose Personal information (except where, as noted below, we are authorized to do so without consent).

Consent can be provided orally, in writing, electronically, through an authorized representative or it can be implied where the purpose for collecting using or disclosing the personal information would be considered obvious and you voluntarily provides personal information for that purpose.

Per example, by using the Website or our mobile application, you are consenting to our processing of your information as set forth in this Privacy Policy now and as amended by us from time to time.

Your Consent will also be implied in all situations stated in the present Privacy Policy.

Consent may also be implied where you received notice and a reasonable opportunity to opt-out your personal information being used for mail-outs, the marketing of new services or products, fundraising and you do not opt-out.

1. What Does This Privacy Policy Cover?

This Privacy Policy is incorporated into the Oralys Terms of Use and covers Oralys’s treatment of personally identifiable information (“Personal Information”) that Oralys gathers when You access the Website and when You use Oralys’s services, regardless of how You access it, and by using Oralys’s Website You consent to the collection, transfer, processing, storage, disclosure and other uses described in this Privacy Policy. All of the different forms of data, content, and information described below are collectively referred to as “information”. This policy does not apply to the practices of companies that Oralys does not own or control, or to individuals that Oralys does not employ or manage. Capitalized terms used in this Privacy Policy and not otherwise defined shall have the meanings provided for those terms in Oralys’s Terms of Service.

2. What Information Does Oralys Collect?

The information We gather from customers enables us to personalize and improve our services. We collect the following types of information from our customers:

A) Personal Information You Provide to Us:

We receive and store any information You enter on our Website or provide to us in any other way. The types of Personal Information collected may include Your full name, email address, mobile phone number, credit card and/or other payment information, IP address, browser information, username, password, employer, company address, company size, job function or title and any other information necessary for us to provide our services. You can choose not to provide us with certain information, but then You may not be able to take advantage of many of our special features. The Personal Information You provide is used for such purposes as answering questions, sending product updates, and communicating with You about Oralys’s products and services, including specials and new features. We also collect and store the files You upload, download, or access with the Oralys Website.

Accuracy of Personnal Information: In order to provide You with a good level of service, the personal information that we collect must be accurate, complete and current. From time to time, You may be asked to update your personal information. You are encouraged to advise us of any changes to your personal information that may be relevant to the services we are providing.

B) Personal Information Collected Automatically:

We receive and store certain types of information whenever You interact with our Website or use our services. Oralys automatically receives and records information on our server logs from Your browser including Your IP address, cookie information, and the page.

Generally, our service automatically collects usage information, such as the numbers and frequency of visitors to our Website and its components, similar to TV ratings that indicate how many people watched a particular show. Oralys only uses this data in aggregate form, that is, as a statistical measure, and not in a manner that would identify You personally. This type of aggregate data enables us to figure out how often customers use parts of the Website or services so that We can make the Website appealing to as many customers as possible, and improve those services. As part of this use of information, We may provide aggregate information to our partners about how our customers, collectively, use our Website or services. We share this type of statistical data so that our partners also understand how often people use the Website or services, so that they, too, may provide You with an optimal online experience. Again, Oralys never discloses aggregate information to a partner in a manner that would identify You personally.

When using the mobile application, we may use GPS technology (or other similar technology) to determine your current location in order to determine the city you are located within and display a location map with relevant advertisements. We will not share your current location with other users or partners. If you do not want us to use your location for the purposes set forth above, you should turn off the location services for the mobile application located in your account settings or in your mobile phone settings and/or within the mobile application. 

C) E-mail Communications:

We often receive a confirmation when You open an email from Oralys if Your computer supports this type of program. Oralys uses this confirmation to help us make emails more interesting and helpful. We also compare our customer list to lists received from other companies, in an effort to avoid sending unnecessary messages to our customers. When You receive e-mail from Oralys, You can opt out of receiving further e-mails by following the included instructions to unsubscribe.

D) Limit

Oralys will limit the collection of personal information to that which is reasonably required to provide our services or operate our business.

3. What About Cookies?

Cookies are alphanumeric identifiers that we transfer to Your computer’s hard drive through Your browser to enable our systems to recognize Your browser and tell us how and when pages in our site are visited and by how many people. We use cookies to enhance visitors’ experiences, to learn more about their use of the Website and to improve quality. We may store some "cookie") on your computer when you look at our Website;

Social Media Features: Our website may uses social media features (“Social Features”) provided by companies and services such as Facebook, Twitter and YouTube, to enable You to share information via these channels. These cookies are owned and controlled by third parties, and therefore the third parties – and not Oralys – are responsible for their use. As such, We can’t guarantee that we have listed every cookie You might get from a third party since a third party could change these cookies at any time as their needs change. When You visit a page on the Oralys Website that contains Social Features, Your browser establishes a direct connection to the applicable social network’s servers. The Social Features provide the social networks with the information that You have accessed on Oralys’s Website, and, if You are logged into the social network, Your visit may be logged to Your account on that service. For example, if You click the Facebook “Like” button, that information is transmitted from Your browser directly to Facebook and stored by it. 4. Will Oralys shares any of the Personal information it receives?

Personal Information about our customers is an integral part of our business. Subject to the following, we neither rent nor sell Your Personal Information to anyone. From time to time We would like to use your personal information for purposes other than as set out in the above section.

Internal use: Personal Information may also be shared internally and with other member of Oralys in order to allow us to offer services or products.

Affiliated Businesses: Personal Information may also be shared with our trusted services providers who work on our behalf, do not have an independent use of the information we disclose to them, and have agreed to adhere to the rules set forth in this privacy statement.

Affiliated Businesses We Do Not Control: We anticipate that We may become affiliated with a variety of businesses and work closely with them. In certain situations, these businesses may sell items to You through the Website. In other situations, Oralys may provide services, or sell products jointly with affiliated businesses. You can easily recognize when an affiliated business is associated with Your transaction, and we will share Your Personal Information that is related to such transactions with that affiliated business.

Agents: We may employ other companies and people to perform tasks on our behalf and need to share Your information with them to provide products or services to You. You hereby consent to our sharing of Personal Information for the above purposes.

User profiles: User profile information including users’ name, email address, and other information You enter (“User Submissions”) may be displayed to other users to facilitate user interaction within the Website. Email addresses are used to add new User Submissions to user profiles and to communicate through User Submissions. Users’ email addresses will not be directly revealed to other users by Oralys, except, when the user is “connected” to another user via a shared group membership, or an invitation, or if the user has chosen to include their email address in their User Profile.

Communication in response to User Submissions: As part of the Website and services, You will receive from Oralys email and other communication relating to Your User Submissions. You acknowledge and agree that by posting such User Submissions, Oralys may send You email and other communication that it determines in its sole discretion relate to Your User Submissions.

Promotional Offers: We may send offers to You on behalf of other businesses.

We may give your name, address and e-mail and any other personal data you supply to us to carefully selected third parties, which may be located outside of Canada. These third parties may only use this information for:

  • market research and tracking of sales data
  • sending you information about their products and services
  • giving the information to their affiliate offices and companies to enable them to send you information which may be of interest to you.

If You do not wish to receive these offers, You will be able to opt out of receiving further messages through a link in the email message containing the offer.

Business Transfers: In some cases, we may choose to buy or sell assets. In these types of transactions, customer information is typically one of the business assets that are transferred. Moreover, if Oralys, or substantially all of its assets were acquired, or in the unlikely event that Oralys goes out of business or enters bankruptcy, customer information would be one of the assets that is transferred or acquired by a third party. You acknowledge that such transfers may occur, and that any acquirer of Oralys may continue to use Your Personal Information as set forth in this policy.

With Your Consent: Except as set forth in the present Policy, You will be notified when Your Personal Information may be shared with third parties, and will be able to prevent the sharing of this information.

Protection of Oralys and Others: We may release Personal Information without your consent when we believe in good faith that release is necessary for the purpose of acting in respect of an emergency that threatens the life, health or security of an individual, including steps taken under our pandemic policies, or as otherwise permitted by law including for purposes of an investigation. We may also disclose personal information if permitted or required by applicable federal and provincial privacy laws, including:

  to comply with a subpoena, a warrant or an order made by a court or other body with appropriate jurisdiction or to comply with rules of conduct required by regulatory bodies

  to a government institution that has requested the information, identified its lawful authority, and indicates that disclosure is for the purpose of enforcing, carrying out an investigation, or gathering intelligence relating to any federal, provincial or foreign law; or suspects that the information relates to national security or the conduct of international affairs; or is for the purpose of administering any federal or provincial law

  to an investigative body or government institution on our initiative when we believe the information concerns a breach of an agreement, or a contravention of a federal, provincial, or foreign law, or we suspect the information relates to national security or the conduct of international affairs.

5. Is Personal Information About me Secure?

Oralys is taking the security measures necessary to ensure the protection of the Personal information collected, used, communicated, kept or destroyed and that are reasonable given the sensitivity of the information, the purposes for which it is to be used, the quantity and distribution of the information and the medium on which it is stored.

Your Oralys account Personal Information is protected by a password for Your privacy and security. You need to ensure that there is no unauthorized access to Your account and Personal Information by selecting and protecting Your password appropriately and limiting access to Your computer and browser by signing off after You have finished accessing Your account.

Oralys endeavors to protect user information to ensure that user account information is kept private, however, Oralys cannot guarantee the security of user account information. Unauthorized entry or use, hardware or software failure, and other factors, may compromise the security of user information at any time.

The Website contains links to other sites. Oralys is not responsible for the privacy policies content, accuracy and/or practices on other sites. When linking to another site You should read the privacy policy stated on that site. This Privacy Policy only governs information collected on the Website.

6. What personal information can I access?

Oralys, at your request, will confirm the existence of the file and communicate to you any of your personal information.

From time to time, Oralys may refuse for legal purpose to communicate to your any of your personal information. In such case, Oralys will inform you of his refusal in writing, giving reasons, and informing you the recourses open.

No request for access or rectification may be considered unless it is made in writing by a person who proves that he is the person concerned or the representative, heir or successor of that person, the liquidator of the succession, a beneficiary of life insurance or of a death benefit or the person having parental authority even if the minor child is dead.

Oralys will allow You to access the following information about You for the purpose of viewing, and in certain situations, updating that information. This list will change as the Website changes.

  • Account and user profile information
  • User e-mail address
  • Username and password

7. What Choices Do I Have?

As stated previously, You can always opt not to disclose information, even though it may be needed to take advantage of certain features of the Website and services.

You are able to add or update certain information on pages, such as those listed in the “What Personal Information Can I Access” section above. When You update information, however, we often maintain a copy of the unrevised information in our records.

You may request deletion of Your Oralys account by submitting a ticket at http://www.oralys.ca/contact-us/ . Please note that some information may remain in our records after deletion of Your account.

Please notify us if You do not wish to receive email or other mail from us. Please note that if You do not want to receive legal notices from us, such as this Privacy Policy, those legal notices will still govern Your use of the Website, and You are responsible for reviewing such legal notices for changes.

8. Changes to this Privacy Policy

Oralys may amend this Privacy Policy from time to time. Use of information we collect now is subject to the Privacy Policy in effect at the time such information is used. If We make changes in the way We use Personal Information, We will notify You by posting an announcement on the Website or sending You an email. We will ask for your consent to such changes if required by applicable law. In other cases, please note that your continued use of the Website after any change means that You agree with, and consent to be bound by, the new Privacy Policy. If You disagree with any changes in this Policy and do not wish Your information to be subject to the revised Policy, You will need to close Your account.

9. Effective Date

These Terms of Use are effective as of April 15, 2015, and shall remain in effect until modified and/or updated as provided in Section 8 above.
