Lifetime Warranty

If a CD or card has been damaged by the user through normal use, Oralys Inc. will replace the damaged component upon return under the condition it was accompanied by a return address as well as a cheque or money order covering the cost of replacement, labor, shipping and handling. Oralys Inc. may not be held liable for any resulting indirect or accessory damages.

The Oralys Software Limited Warranty

Oralys Inc. warrants that the software will be free from defects in material and craftsmanship and will perform according to accompanying user documentation for a period of 90 days from the date of receipt. If a warranted CD becomes defective during this period, Oralys will replace or repair the software free of charge. Proof of purchase must be presented in order for the warranty to be valid. IT IS AGREED THAT REPLACEMENT IS A BUYER'S SOLE REMEDY FOR SUCH LIABILITY.

THE LIMITED WARRANTY SET FORTH HEREIN IS EXCLUSIVE AND IN LIEU OF ANY AND ALL OTHERS, WHETHER EXPRESSED OR IMPLICITLY ASSOCIATED WITH THE ADEQUACY OF THIS PRODUCT, TO THE EXTENT ALLOWED BY LAW.

ORALYS INC. HEREBY DISCLAIMS ANY DIRECT OR CONSEQUENTIAL DAMAGES ASSOCIATED WITH THE INFRINGEMENT OF THIS WARRANTY. Under no circumstances shall Oralys Inc. be liable for any damages, lost revenue; business interruptions, loss of profit or data as a result of use or the inability to use this product. This limitation will apply regardless of any punitive damages, expenses or loss of profits. In no event shall Oralys Inc. be liable to its customer whether in contract, tort (or otherwise) exceeding the price paid for this product.

Some provinces, states or countries do not authorize the exclusion or limitation of the duration of an implied warranty. In the event of such a case, the foregoing limitations and exclusions may not apply.

Should any provision of this agreement prove to be, become or be declared null and void or unenforceable to the extent prohibited by law, the remaining provisions shall be unaffected and shall remain valid and in full effect. THE TERMS OF THIS LIMITED WARRANTY DO NOT AFFECT YOUR STATUTORY RIGHTS IN ANY WAY.
